Property Information

This beautiful private apartment right in the heart of Plateau Mont-Royal, near downtown Montreal. The property is situated on rue Sherbrooke Est - corner of St-Laurent Blvd and rue Sherbrooke Est.
This spacious 900 sqft. apartment is fully furnished with high-end appliances and furniture. It has 1 bedroom, 1 bathroom, fully equipped kitchen, digital cable, free Wi-Fi, washer/dryer, coffee maker and clean towels.
The apartment has a large King bed in the closed bedroom and two Queen beds on the mezzanine, a dining table for up to 6 guests, and a balcony overlook the Sherbrooke street and downtown Montreal. Hardwood floor throughout and supper clean.

Downtown Montreal is only 5 minutes walk. McGill University, Chinatown, Quartier des Spectacles, Old Montreal, museums and more are within walking distance. Bus stop is right in front of the apartment and Metro Station St-Laurent is only few minutes walk. Fine local restaurants, bars and bakery stores are within walking distance.


Parking is available for $15 per day.

ACCOMMODATION
AGREEMENT


 

Lux
Montreal Vacation Rentals (LMVR): The Proprietor that accommodates the Party against remuneration.



Party: M
eans a domestic of foreign individual that uses
accommodation. Guest(s) is also the Party and also include those persons that
are accommodated together with such Party (e.g. family member, friends, etc.).


 

Accommodation Agreement:  Means the
agreement made between the Proprietor and the Party, the contents of which are
specified below.

 



Agreement


 

The Accommodation Agreement shall be deemed entered into upon the receipt
of the Party’s reservation and payment by LMVR.

 



Start and
end of accommodation


 

Unless the proprietor offers any other time of occupancy, the Party
shall be entitled to move into the rented property from 3:00 p.m. on the agreed
date (“Date of arrival”).

 

The rented property shall be vacated by the Party by 11:00 a.m. on the
date of departure. LMVR shall be entitled to charge another day if the rented
property are not vacated on time.

 



Cancellation


The Party shall be
entitled for full refund if LMVR receives the cancellation notice more than
fourteen (14) days before the agreed date of arrival of the Party.

If the Party does not show up, inform LMVR of late arrival within 24 hours of the agreed date of arrival or cancelled
within fourteen (14) days or less of the agreed date of arrival, full payment
will be applied and Reservation will be cancelled.

Unless otherwise
agreed upon. LMVR reserves the right to cancel the reservation at any time for
objectively justified reasons such as a reservation was made fraudulently or in
violation of the Accommodation Agreement.



Payment


All reservations shall be paid in full at
the time of reservation. Reservations
are personal to the Party and cannot be resold or transferred.

Upon arrival at your selected property,
the Party shall provide a valid photo Identification for security purposes and
a credit card in the name of the photo ID to secure accommodation and for a
security deposit of 500.00$ (hereinafter “Security Deposit”). If the Party
comply with all the contents stipulated in this Accommodation Agreement, the
Security Deposit will be released in the next seven days after departure.

Occupancy

All accommodation shall be used for
residential purposes only and to accommodate the number of guests stated on the
Party’s reservation confirmation.

Exceeding the stated number of guests
shall result in a termination of the Party’s reservation and LMV shall require
the Party to vacate the property immediately without refund.



Unavailability of rented property


In the event the rented property
is not available for use during the Rental Term due to reasons, events or
circumstances beyond the control of LMVR. LMVR shall apply due diligence and good
faith efforts to locate a replacement property that equals or exceeds the rented
with respect to occupancy capacity, location and value that meets the
reasonable satisfaction of the Party.  If
such replacement property cannot be found and made available, LMVR shall
immediately return all payments made by the Party, whereupon this Accommodation
Agreement shall be terminated and the Party and LMVR shall have no further
obligations or liabilities in any manner pertaining to this Agreement.



Conditions and use of rented property


The property is rented in “as is”
condition. The Party shall use the property and the manipulation of all
amenities in the property such as fireplace, BBQ grill, deck and the like in a
careful manner to prevent any damage, loss of property or potential risks, and
acknowledges that such use is at the Party’s own risks.

LMVR cannot guarantee against breakdown of
air conditioning or other appliances. Please report any non-operative equipment
to our office promptly. LMVR will make every effort to have repairs done quickly
and efficiently. Should a repairman make a call to a unit and find that the
equipment is in working order and the problem was due to the Party oversight or
neglect, all charges for the service will be charged to the Party’s credit card
on file. No rental refunds will be made due to failure of air
conditioning, other appliances or items beyond our control.

The Party shall leave premises in clean,
undamaged condition. The Party shall be responsible for the care of the premises, appliances and furnishings and for any damage by
negligent or wrongful acts caused by the Party.

The Party shall behave in a civilized
manner and shall be a good neighbor respecting the rights of surrounding
property owners and guests. The Party shall not disturb, annoy, endanger,
and/or interfere with surrounding property owners and guests.

 

 



Parties


LMVR has a zero tolerance policy for any
house type parties with excessive use of alcohol in or at the property. If
there is damage or LMVR is called for a disturbance related to such activity, we
will call the local law enforcement to handle the situation. If excessive noise
or disturbances occur resulting in notification by police or neighbors, the
Party shall vacate the rented property immediately and forfeit the right of the
return of any unused rental fees and the Security Deposit.  Quiet hours
are from 11 p.m. to 8:30 a.m.

Smoking

No smoking shall be allowed inside the
property. Smoking inside of the Property is strictly prohibited at all times.
The Party shall be responsible for all damage caused by the smoking, including
but not limited to, stains, burns, odor and removal of debris. The Party violating
this policy shall vacate the rented property immediately and forfeit the right
of the return of any unused rental fees and the Security Deposit. 

Pets

No pets shall be
allowed in or on the property. If an unauthorized pet
is in the rented property, the Party shall be responsible for all damage caused
by pet. The Party shall be required to immediately leave the rented property and
forfeits the right of the return of any unused rental fees. The Party violating
this policy shall vacate the rented property immediately and forfeit the right
of the return of any unused rental fees and the Security Deposit.  An
extra charge may apply on the Party’s credit card for all costs exceeding the
Security Deposit incurred by LMVR to repair any damage to the rented property
caused by the pet. 



Furnishings and cleaning


The rented property
is equipped with basic housekeeping items such as pillows, blankets, bath
towels, furniture, kitchen appliances, pots, pans, dishes, glassware and
silverware. The Party is expected to use the property as if it were their own,
leave it undamaged, clean, and with all trash disposed in the trash can
provided. Specific departure cleaning requirements are as follows but are not
limited to: all kitchen, cooking, eating, drinking equipment shall be cleaned.
Furniture shall be in its original place and position. Failure to perform
check-out requirement may result in an additional cleaning charge deducted from
the Security Deposit.



Telephone/Pay Per View/ Internet


Telephones are
provided for local calls only. If long distance charges incurred during the
Party’s stay. The Party shall be billed $15 in addition to the cost of the call
and the total amount shall be deducted out of the Security Deposit.

Pay Per View or On-Demand
cable service is not included in the rented property. Any Pay Per View or
On-Demand cable charges incurred during the Party’s stay shall be automatically
charged to the credit card on file or deducted out of the Security Deposit.

By electing to use
Wi-Fi provided in the rented property, the Party assumes all risks and hold LMVR harmless in the event of any damage the Party may suffer due to security
breaches. The Party agrees not to download or transmit any unlawful material or
any material that infringes on copyright or any other proprietary rights of any
party. Internet activity is electronically monitored and any violations shall
be reported along with the Party contact information to the proper authorities.



Entry
and inspection


LMVR and its employees, contractors and
agents shall have the right to enter the Property at any time in case of
emergency.  LMVR and its employees, contractors and agents shall further
have the right to enter the Property at a reasonable times and with reasonable
advance notice for the purposes of inspecting the property.



Risk of loss and Indemnification


The Party agrees that all
personal property, furnishings, personal affects and other items brought into
the rented property by the Party shall be at the sole risk of the Party with
regard to any theft, damage, destruction or other loss and LMVR shall not be
responsible or liable for any reason whatsoever.

The Party hereby covenants and
agrees to indemnify and hold harmless LMVR and their agents, owners, successors,
employees and contractors from and against any costs, damages, liabilities,
claims, disputes, litigation, judgement, costs and attorney fees incurred by the
Party due to any claims relating to destruction of property or injury to
persons or loss of life sustained by the Party in or about the rented property
and the Party expressly agrees to save and hold LMVR harmless in all such cases.



General provisions


This Accommodation Agreement
contains the entire agreement between the Party and LMVR. Any changes or
modifications hereof shall be written and signed by the Party and LMVR. This
Agreement shall be governed by the laws of the province of Quebec.

This Accommodation Agreement
binds the Party and LMVR. The waiver or failure to enforce any breach or
provision of this Accommodation Agreement shall not be considered a waiver of
that or any other provision in any subsequent breach thereof. 

If any provision herein is
held invalid, the remainder of the Agreement shall not be affected. 

Any notice required to be
given under this Accommodation Agreement shall be in writing and sent to the
contact information included in the Reservation confirmation.
